broken from the factory or in shipping?

I just got a new in box Pajero and it is already broken. I just got it yesterday and the rear axle has broken from the retaining bits so it swings around like crazy. What gives? None of my other tamiya cars are like this? Solid as a rock. Xpert Built huh? Now I gotta ship it back to the states. >:( Has anyone else had anything broken from the factory?

My LHS had a delivery of Tamiya bodies, 3 Merc DTM's and a pair of Focus WRC's. All had the decals peeled off the sheet and stuck to the inside of the bag.

Also, they had a Terra Crusher sent back to Tamiya twice as the engine wouldn't idle, despite the settings.

Well I called tower hobby the place where i bought my car from and they are shipping my stuff now. Now that is what I call customer service. I know some of the LHS's I've been in here should follow in the same foot steps.
